011. Introduction and Acceptance
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "Player," or "Member") and Dayo, I.T. Services. ("Dayo," "we," "us," or "our"), governing your access to and use of the Dayo mobile application and all related services (the "Service").
By creating an account or using the Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service. If you are under 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
1.2 What These Terms Cover
These Terms govern and apply comprehensively to your access to and use of the Dayo platform and all associated services, whether accessed via the mobile application (including iOS and Android versions), web interfaces, or any other authorized digital channels made available by the Company. This includes, without limitation, your creation, maintenance, and use of your personal account and profile; your participation in any matches, games, events, or community activities facilitated through the Service; your purchase, use, or redemption of virtual currency, in-app items, or premium features; and all forms of communication, interaction, or engagement with other users conducted within or through the platform. Furthermore, these Terms apply to all data, information, content, and materials that you submit, upload, share, or otherwise make available via the Service, as well as any data collected from or about you in connection with your use of the platform. By accessing or using any part of the Service, you acknowledge and agree that all such activities are subject to these Terms, applicable laws and regulations, and any additional policies or guidelines that may be incorporated herein by reference.
1.3 Other Important Documents
These Terms operate in conjunction with other legal documents, policies, and applicable regulations that collectively govern your use of the Dayo platform and its services. In the event of any inconsistency, conflict, or ambiguity between these documents, the order of precedence shall be determined as outlined below, with the highest authority taking priority and prevailing over those listed thereafter.
1.3.1 Applicable Laws
Applicable laws refer to all relevant statutes, regulations, and legal requirements enforced within the Republic of the Philippines, including but not limited to cybercrime laws, consumer protection laws, data privacy regulations, and electronic commerce laws. These laws take absolute precedence over all other documents and govern the legality of all actions, transactions, and activities conducted through the Service.
1.3.2 Community Guidelines
The Community Guidelines establish the standards of conduct, acceptable behavior, and content rules that all users must follow when interacting within the platform. These guidelines are designed to maintain a safe, respectful, and fair environment for all users and may include enforcement actions, restrictions, or penalties for violations.
1.3.3 Privacy Policy
The Privacy Policy outlines how Dayo collects, processes, stores, shares, and protects user data and personal information. It provides transparency regarding data handling practices, user rights, and compliance with applicable data protection laws, including the Data Privacy Act of 2012.
1.3.4 Terms of Service
These Terms of Service constitute the primary contractual agreement between you and Dayo, defining the rules, rights, obligations, and limitations associated with your use of the platform. While comprehensive, these Terms are subordinate to applicable laws and must be interpreted in alignment with higher-priority documents listed above.
1.4 Acceptance of Terms
By accessing, registering for, or using the Dayo platform and any of its services, you expressly acknowledge that you have read, understood, and agreed to be legally bound by these Terms of Service and all applicable policies incorporated herein by reference. Your continued use of the Service constitutes your full and unconditional acceptance of all terms, conditions, obligations, and restrictions set forth in this agreement. You further agree to comply with all applicable laws, platform rules, and community standards, and acknowledge that any violation of these Terms may result in enforcement actions, including but not limited to suspension, restriction, or permanent termination of your account. Additionally, you agree to be bound by any dispute resolution mechanisms specified within these Terms, including binding arbitration as outlined in Section 16, where applicable.
If you do not agree to any part of these Terms, you must immediately discontinue all access to and use of the Service. This includes refraining from creating an account, ceasing any ongoing use of the platform, and, if applicable, permanently deleting your account and any associated data. Continued use of the Service despite disagreement with these Terms constitutes a knowing and intentional violation of this agreement.
022. Eligibility & Eligibility Requirements
2.1 Age Requirements
To access and use the Dayo platform, you must meet specific eligibility criteria relating to age and legal capacity. By registering for or using the Service, you represent and warrant that you satisfy all applicable requirements outlined in this section, and that any information you provide in connection with your eligibility is accurate and truthful.
2.1.1 Minimum Age Requirement
You must be at least thirteen (13) years of age to access or use the Service. Individuals below this minimum age are strictly prohibited from creating an account or using any part of the platform.
2.1.2 Legal Capacity
You must have the legal capacity to enter into a binding agreement under the laws of your jurisdiction. If you do not possess such legal capacity, you may only use the Service with the involvement and consent of a parent or legal guardian, where permitted by law.
2.1.3 Legal Eligibility
You must not be prohibited from accessing or using the Service under any applicable laws, regulations, or legal restrictions within your jurisdiction. Any use of the platform in violation of applicable law is strictly prohibited.
2.1.4 Age Verification
During the registration process, you are required to provide accurate information, including your date of birth, for the purpose of verifying your eligibility. By submitting this information, you affirm that it is truthful and correct. Dayo reserves the right to suspend or permanently terminate accounts found to have provided false or misleading age information, including cases where a user falsely claims to meet the minimum age requirement.
2.1.5 Parental Consent for Minors (Ages 13–17)
If you are between the ages of thirteen (13) and seventeen (17), you are required to obtain permission from a parent or legal guardian prior to using the Service. Parents or guardians are responsible for supervising the minor’s use of the platform and may enable available parental controls where applicable. By allowing a minor to use the Service, the parent or guardian agrees to these Terms on behalf of the minor and assumes responsibility for the minor’s activities.
2.2 Legal Restrictions
Your access to and use of the Dayo platform is subject to certain legal and eligibility restrictions. By using the Service, you represent and warrant that none of the prohibitions outlined in this section apply to you. Dayo reserves the right to deny, suspend, or terminate access to any user found to be in violation of these restrictions.
2.2.1 Minimum Age Violation
You are prohibited from using the Service if you are under thirteen (13) years of age. Any account found to be operated by an individual below the minimum age requirement will be subject to immediate termination without prior notice.
2.2.2 Prior Account Ban
You may not use the Service if you have previously been permanently suspended or banned from Dayo. Attempts to circumvent enforcement actions, including creating new accounts after a ban, are strictly prohibited and may result in further legal action.
2.2.3 Legal Prohibition
You are not permitted to use the Service if you are restricted or prohibited under any applicable law, regulation, or legal order from accessing or using online platforms, digital services, or participating in online communities.
2.2.4 Restricted Offenders
Individuals classified as registered sex offenders or subject to similar legal designations are prohibited from using the Service, as further detailed in Section 2.3. Dayo prioritizes user safety and reserves the right to take appropriate action to enforce this policy.
2.2.5 Restraining Orders Involving Users
You are prohibited from using the Service if you are subject to any restraining order, protection order, or similar legal directive involving another Dayo user, where such use may violate the terms of that order or pose a risk to other users.
2.2.6 Court-Imposed Restrictions
You may not use the Service if you are subject to any court order, probation condition, or legal restriction that limits or prohibits your ability to access or engage in online activities, digital communications, or internet-based services.
2.3 Sex Offender Registration Requirement
To ensure the safety and integrity of the Dayo community, strict eligibility requirements apply to individuals with certain criminal designations. By accessing or using the Service, you represent and warrant that you are not a registered sex offender in the Philippines or in any other jurisdiction. This representation is a material condition of your continued access to the platform.
2.3.1 Prohibition on Registered Sex Offenders
Individuals who are listed or required to register as sex offenders under any applicable law are strictly prohibited from accessing or using the Service. Dayo enforces a zero-tolerance policy in this regard to protect its users and community environment.
2.3.2 Legal Consequences
If you are a registered sex offender and access or use the Service, you may be in violation of applicable laws, regulations, or registration conditions imposed upon you by relevant authorities. Such violations may result in criminal liability, investigation, or prosecution by law enforcement agencies.
2.3.3 Violation of Probation or Parole Terms
Accessing or using the Service while subject to probation, parole, or other supervised release conditions may constitute a breach of those terms, particularly if such conditions restrict internet usage, social interaction, or access to certain platforms.
2.3.4 Enforcement and Account Termination
Dayo reserves the right to investigate, monitor, and take appropriate enforcement action against any account suspected of violating this section. If it is determined that a user is a registered sex offender, the account will be subject to immediate suspension or permanent termination without prior notice, and may be reported to appropriate authorities where required by law.
In Plain Language:
If you're required by law to register as a sex offender, you should
not use Dayo. Doing so may be illegal, and we will ban you if we find
out. This is to protect young users on our platform.
2.4 Territory Restrictions
Access to and use of the Dayo platform is subject to geographic availability and jurisdictional limitations. The Service is primarily intended for use within supported territories, and your ability to access certain features may vary depending on your location. By using the Service, you represent and warrant that you are accessing it from a permitted jurisdiction and in compliance with all applicable laws.
2.4.1 Supported Territory
The Dayo platform is currently intended for use within the Republic of the Philippines. Availability of features, services, and support is optimized for users located within this jurisdiction.
2.4.2 Restricted Territories
Users located in jurisdictions where access to the Service is restricted, limited, or prohibited by law may be unable to use all or part of the platform. Dayo reserves the right to block or restrict access from such territories at its sole discretion.
2.4.3 Change of Location
If you relocate to a territory where the Service is restricted or unsupported, your access to the platform may be limited, suspended, or terminated. Continued use of the Service from such locations may constitute a violation of these Terms and applicable laws.
2.4.4 Payment Limitations
Certain payment methods, financial features may not be available in all territories. Availability of payment services is subject to third-party providers, local regulations, and operational constraints, and may change without prior notice.
033. Account Registration and Security
To access most features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must notify us immediately at dayo.ph.it.services@gmail.com if you discover or suspect any unauthorized use of your account or any other security breach. We will not be liable for any loss or damage arising from your failure to protect your account credentials.
You may only maintain one account unless we expressly authorize otherwise. Creating multiple accounts to evade a ban or other enforcement action is prohibited.
3.1 Account Registration
To access and use the Dayo platform, you are required to create and maintain a valid user account. By registering, you agree to provide accurate, complete, and up-to-date information and to comply with all eligibility requirements outlined in these Terms. Account registration is a prerequisite for accessing core features of the Service.
3.1.1 Account Creation Requirements
To create an account, you must authenticate using a valid Google account and complete the registration process as required by the platform. You must also confirm that you meet the minimum age requirement of thirteen (13) years or older. Failure to meet these requirements will result in denial of access to the Service.
3.1.2 Information You Provide
During registration and throughout your use of the Service, you may be required to provide certain personal and profile information. This includes your Google (Gmail) email address, which must be valid and actively monitored by you; your name, which may be your real name or a chosen username; and your date of birth, which is required for age verification. You may also optionally provide additional information such as your phone number, profile photo, personal bio or description, and location data for matching and service optimization purposes. You are responsible for ensuring that all information provided remains current and accurate.
3.1.3 Accuracy and Integrity of Information
By registering an account, you represent and warrant that all information you provide is true, accurate, complete, and not misleading. You further confirm that such information is lawfully obtained, does not involve impersonation or misrepresentation, and pertains solely to you. The use of false, fraudulent, or third-party information is strictly prohibited and may result in immediate suspension or termination of your account, as well as potential legal consequences where applicable.
3.2 Account Password & Security
The security of your account is a critical component of your use of the Dayo platform. By registering through your Google account, you acknowledge that authentication credentials associated with your Gmail account serve as the primary means of accessing the Service. You are solely responsible for maintaining the confidentiality and security of your account credentials and for all activities that occur under your account.
3.2.1 Credential Security
Your Gmail password and associated login credentials must be kept secure and confidential at all times. You must not share your login details with any third party, whether intentionally or negligently. Any access to your account through your authenticated credentials will be presumed to be authorized by you.
3.2.2 User Responsibilities
You are fully responsible for all activities conducted through your account, including any actions taken by individuals who gain access to your account, whether authorized or unauthorized. This includes maintaining the confidentiality of your credentials, securing your devices (such as mobile phones or computers), logging out of your account when appropriate, and promptly notifying Dayo of any suspected or actual unauthorized access, security breach, or misuse of your account. You also acknowledge that you bear responsibility for any consequences arising from compromised credentials due to your failure to maintain adequate security practices.
3.2.3 Limitation of Liability
To the maximum extent permitted by applicable law, Dayo shall not be held liable for any loss, damage, or unauthorized activity resulting from your failure to safeguard your account credentials or devices. This includes, but is not limited to, situations where you voluntarily share your password with others, fail to secure your device, or become a victim of phishing, social engineering, or other fraudulent schemes. Any actions performed under your account will be treated as your responsibility unless otherwise required by law.
3.3 Account Deletion
You have the right to request deletion of your Dayo account at any time, subject to the procedures and limitations outlined in this section. Account deletion is a permanent action that removes access to the Service and may result in the loss of associated data, content, and entitlements.
3.3.1 Account Deletion Process
To delete your account, you must follow the in-app deletion procedure: navigate to Profile, select "Privacy & Security",” choose “Delete Account,” and confirm and continue your request. Once confirmed, your account will be deleted.
3.3.2 Effects of Account Deletion
Upon successful deletion of your account, your account will be permanently removed from the Service. This includes deletion or anonymization of your personal data, content, profile information, and match history associated with your account. Any virtual currency, in-app purchases, or unused entitlements will be forfeited and are non-refundable.
3.3.3 Data Retention and Anonymization
Certain data may be retained in anonymized or aggregated form for legal compliance, fraud prevention, dispute resolution, or system integrity purposes. Such retained data will not be linked to your personal identity once anonymized.
3.3.4 Account Reactivation and Re-Registration
Once an account has been deleted, it cannot be restored or reactivated under the same credentials. You may create a new account, subject to compliance with these Terms. Any new account will be treated as a separate and independent account, with no restoration of prior data, history, or entitlements.
044. Permitted Use and License
Subject to your full and ongoing compliance with these Terms, Dayo grants you a limited, personal, non-exclusive, non-transferable, and revocable license to access and use the Service solely for lawful personal and non-commercial purposes. This license is intended to enable users to engage in sports-related activities within the platform, including organizing and participating in matches, joining clubs and communities, connecting with other users, and accessing or purchasing available in-app features and virtual items. This license does not grant you any ownership rights over the Service or its underlying systems.
You agree that you will not use the Service for any unlawful, prohibited, or unauthorized purposes, nor in any manner that could damage, disable, overload, disrupt, or impair the integrity, performance, or availability of the Service. You further agree not to interfere with or restrict any other user’s ability to access or enjoy the platform.
4.1 Limited License Grant
Under this agreement, Dayo grants you a limited, non-exclusive, non-transferable license to use the Service strictly in accordance with these Terms. This license is provided solely for your personal use and does not constitute a transfer of ownership or intellectual property rights.
4.1.1 Scope of License
You are permitted to download and install the Dayo application on your personal devices, use the application for personal, non-commercial purposes, create one or more user accounts where permitted by the platform, access and view content made available through the Service, participate in matches, events, and leagues, communicate with other users, post user-generated content such as photos and text, and purchase virtual currency or in-app items where available.
4.1.2 Nature of Rights Granted
This license grants you permission to use the Service only while you comply with these Terms. It is strictly personal to you and may not be assigned, transferred, sublicensed, or otherwise shared with any other individual or entity. You may not use the Service for commercial exploitation, resale, or any business-related purpose unless explicitly authorized by Dayo in writing.
4.1.3 Ownership and Intellectual Property
You acknowledge that you do not own the Dayo platform, its software, infrastructure, features, or underlying technology. All rights, title, and interest in and to the Service, including but not limited to the name “Dayo,” logos, branding, design elements, software, and system architecture, remain the exclusive property of Dayo or its licensors. You also acknowledge that you do not own any content or data belonging to other users.
4.2 Permitted Use
The Service is intended to support safe, respectful, and community-driven sports and social engagement. Subject to compliance with these Terms, you are permitted to use the platform in the following ways:
4.2.1 Use the application for personal sports-related activity and engagement
4.2.2 Create and maintain a user profile with accurate information
4.2.3 Post photos, videos, text, and other permitted content
4.2.4 Comment on and interact with content posted by other users
4.2.5 Send messages and communicate with other users through available features
4.2.6 Join and participate in matches, events, leagues, clubs, and communities
4.3 Prohibited Use
You agree that your use of the Dayo platform must at all times comply with these Terms, applicable laws, and generally accepted standards of lawful and ethical online conduct. The following activities are strictly prohibited and constitute material violations of these Terms. Engaging in any of the conduct listed below may result in immediate suspension or termination of your account and may also lead to legal action where applicable.
4.3.1 Illegal and Unauthorized Use
4.3.1.1 Using the Service for any unlawful, criminal, or unauthorized purpose
4.3.1.2 Using the Service in violation of applicable laws or regulations
4.3.1.3 Using the Service while subject to legal restrictions or court orders prohibiting such use
4.3.2 Commercial and Unauthorized Exploitation
4.3.2.1 Using the Service for commercial purposes without prior written authorization from Dayo
4.3.2.2 Reselling, sublicensing, or monetizing the Service or its features without permission
4.3.3 Account Abuse and Misrepresentation
4.3.3.1 Creating multiple accounts to evade bans, restrictions, or enforcement actions
4.3.3.2 Sharing, selling, or transferring your account to another person
4.3.3.3 Impersonating another person, user, or entity, or providing false identity information
4.3.4 Technical Abuse and Security Violations
4.3.4.1 Using bots, scripts, automation tools, or unauthorized software to access the Service
4.3.4.2 Attempting to hack, disrupt, or gain unauthorized access to systems or accounts
4.3.4.3 Circumventing, disabling, or interfering with security features or access controls
4.3.4.4 Exploiting bugs, glitches, or vulnerabilities for unfair advantage or gain
4.3.4.5 Reverse-engineering, decompiling, or extracting source code from the application
4.3.5 Data Misuse
4.3.5.1 Copying, scraping, harvesting, or collecting user data without authorization
4.3.5.2 Using automated systems to extract information from the Service
4.3.6 Harmful Conduct and Content
4.3.6.1 Harassing, threatening, bullying, or abusing other users
4.3.6.2 Spamming, sending unsolicited mass messages, or disruptive communication
4.3.6.3 Posting or sharing illegal, harmful, or prohibited content
4.3.6.4 Violating intellectual property rights of Dayo or third parties
4.3.7 Other Prohibited Activities
4.3.7.1 Using the Service to facilitate illegal gambling activities
4.3.7.2 Trading, promoting, or distributing counterfeit or illegal goods
4.3.7.3 Using VPNs or similar tools to bypass geographic or security restrictions
4.4 Restrictions on Device & Software
Your access to and use of the Dayo platform is subject to strict device and software integrity requirements. These rules are designed to maintain platform security, prevent unauthorized modifications, and ensure consistent performance across all users. Any violation of this section may result in restriction or termination of access to the Service.
4.4.1 Device Restrictions
4.4.1.1 You are permitted to install and use the Dayo application only on devices that you own or lawfully control, and you must ensure you have proper authorization before installation on any device.
4.4.1.2 You must not install or operate the application on any device without the explicit permission of the device owner or lawful controller.
4.4.1.3 You are strictly prohibited from modifying, altering, or tampering with any part of the application, including its files, data, or internal code.
4.4.1.4 You must not use rooted (Android) or jailbroken (iOS) devices for the purpose of bypassing security restrictions or modifying the behavior of the Service.
4.4.1.5 You must not use any modified, hacked, or unofficial versions of the Dayo application under any circumstances.
4.4.2 Software Restrictions
To ensure the integrity, security, and reliability of the Service, you agree to use only official versions of the Dayo application distributed through authorized platforms. Unauthorized software modifications or distribution methods are strictly prohibited.
4.4.2.1 You are encouraged to keep the application updated to the latest official version to ensure optimal performance and security.
4.4.2.2 You must download and install the Dayo application exclusively from official app distribution platforms such as Google Play Store or Apple App Store.
4.4.2.3 You are prohibited from using side-loaded, pirated, or otherwise unofficial versions of the application.
4.4.2.4 You must not use modified clients, plugins, scripts, or any unauthorized third-party tools that alter, interfere with, or replicate the functionality of the Service.
055. User Content and Intellectual Property Rights
The Service allows you to post, upload, and share content such as profile photos, match results, club posts, comments, and messages (collectively, "User Content"). You retain ownership of your User Content. By submitting User Content to the Service, you grant Dayo a worldwide, royalty-free, non-exclusive license to use, display, reproduce, and distribute your User Content within the Service for the purpose of operating and improving the platform.
You are solely responsible for your User Content. You represent and warrant that your User Content does not violate any third-party rights, including intellectual property rights and privacy rights, and that it complies with these Terms and our Community Guidelines. We reserve the right to remove any User Content that violates these Terms without prior notice.
5.1 Your Content Ownership
This section outlines your ownership rights over content you create and submit through the Dayo platform. Subject to the limited license you grant to Dayo under these Terms, you retain full ownership of your original content.
5.1.1 Content You Create
You retain ownership of all content that you create, upload, post, send, or otherwise submit to the Service, including but not limited to photos and videos you upload, text posts and comments you publish, profile and bio information you provide, and messages or private communications you send through the platform.
5.1.2 Meaning of Ownership Rights
5.1.2.1 You retain ownership of your content, meaning you continue to hold your intellectual property rights in the materials you create, subject to any rights you grant to Dayo under these Terms for the operation and provision of the Service.
5.1.2.2 You may delete your content at any time using the available in-app features, subject to system limitations, backup processes, and applicable legal or regulatory requirements that may require retention in certain circumstances.
5.2 License You Grant to Dayo
By creating, uploading, posting, or otherwise submitting content through the Dayo platform, you grant Dayo a limited, non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use such content solely for the operation, provision, and improvement of the Service, in accordance with these Terms.
5.2.1 Rights Granted to Dayo
You expressly authorize Dayo to host, store, reproduce, display, and distribute your content within the platform as necessary to operate and deliver the Service. This includes the ability to process, review, and moderate content for compliance with these Terms, applicable laws, and community safety standards.
5.2.1.1 Display your content within the application and make it visible to other users where applicable.
5.2.1.2 Store and maintain your content on Dayo’s servers and infrastructure as part of normal platform operation.
5.2.1.3 Review, moderate, and assess content for safety, compliance, spam prevention, and enforcement of platform rules.
5.2.1.4 Remove or restrict access to any content that violates these Terms or applicable law.
5.2.1.5 Analyze content using automated or manual systems to detect spam, abuse, security threats, or other harmful activity.
5.2.2 Limitations on Use of Your Content
Dayo does not sell your personal content or personal data to third parties, nor does it share your private messages with external entities for commercial exploitation. Your content is not used for advertising purposes without your explicit consent where required by law.
5.2.2.1 Dayo does not sell your photos, videos, or personal content to third parties.
5.2.2.2 Dayo does not share your personal data with advertisers for targeted advertising purposes without legal basis or consent where required.
5.2.2.3 Dayo does not use your content in external advertising or promotional materials without your explicit permission.
5.2.2.4 Dayo does not disclose your private messages to third parties except where required by law or for security enforcement purposes.
5.2.2.5 Dayo does not use your content for independent commercial purposes outside the operation and improvement of the Service.
5.3 Our Content & Intellectual Property
All rights, title, and interest in and to the Dayo platform, including its underlying technology, design, content, and branding elements, are owned by or licensed to Dayo. These materials are protected by applicable intellectual property laws, including copyright, trademark, and database rights. Except as expressly granted under these Terms, no rights are transferred to you.
5.3.1 Intellectual Property Owned by Dayo
5.3.1.1 The Dayo application, including all source code, object code, software architecture, and related systems, is the exclusive property of Dayo or its licensors.
5.3.1.2 The Dayo name, logo, brand identity, and all associated trademarks are owned and protected by Dayo and may not be used without prior written authorization.
5.3.1.3 All features, tools, functionality, and technological systems within the Service are proprietary to Dayo and protected under applicable intellectual property laws.
5.3.1.4 All written materials produced by Dayo, I.T. Servicesluding guides, help documentation, FAQs, and policy documents, are protected content owned by Dayo.
5.3.1.5 All databases, data structures, and compilations of information generated or maintained by the Service are the property of Dayo and are protected under applicable database rights and laws.
5.3.2 Prohibited Uses of Dayo Intellectual Property
You are strictly prohibited from using Dayo’s intellectual property without authorization. This includes any actions that infringe upon, misuse, or exploit Dayo’s proprietary materials.

5.3.2.5 You may not develop, distribute, or promote any product or service that is substantially similar to or intended to compete with the Dayo platform using its proprietary information.
5.3.2.6 You may not reverse-engineer, decompile, disassemble, or attempt to extract the source code or underlying structure of the application, except where such restriction is prohibited by applicable law.
5.4 Content Moderation & Removal
Dayo reserves the right, but not the obligation, to monitor, review, moderate, remove, restrict, or disable access to any content on the platform at its sole discretion. This is done to maintain platform safety, enforce compliance with these Terms, and protect users and the integrity of the Service.
5.4.1 Grounds for Content Removal
Dayo may remove, restrict, or take action on any content that is determined, in its sole judgment, to violate these Terms or applicable laws. This includes content that negatively impacts platform safety, user experience, or legal compliance.

5.4.1.2 Content that is illegal, harmful, or promotes unlawful activity.
5.4.1.3 Content that violates the privacy rights of other users or third parties.
5.4.1.4 Content that infringes intellectual property rights or violates copyright, trademark, or related protections.
5.4.1.5 Content containing malware, spam, or other malicious or disruptive elements.
5.4.1.6 Content that has been reported by other users and found to violate these Terms upon review.
5.4.1.7 Content that otherwise violates these Terms or applicable laws.

Dayo may apply enforcement actions based on the severity, frequency, and nature of violations. The following framework is provided as a general guideline and may be adjusted at Dayo’s discretion depending on the circumstances of each case.

5.4.2.2 Second violation: Removal of content and temporary suspension of account access for twenty-four (24) to forty-eight (48) hours.

5.4.3 User Rights and Appeals
Users may request review or clarification regarding content moderation decisions in accordance with platform procedures. Dayo may, at its discretion, allow users to appeal content removal or enforcement actions where appropriate.

5.4.3.2 You may request an explanation for moderation decisions, subject to internal review policies and confidentiality limitations.
5.5 Reporting Content Violations
Dayo provides in-app reporting mechanisms to allow users to flag content or behavior that may violate these Terms, Community Guidelines, or applicable laws. Reporting plays an important role in maintaining a safe and respectful platform environment.

Based on the outcome of the investigation, Dayo may take one or more of the following actions, depending on the severity and nature of the violation:
5.5.3.1 Removal of violating content from the platform.
5.5.3.2 Issuance of warnings, temporary suspension, or permanent termination of the user’s account.
5.5.3.3 Reporting of serious violations to relevant law enforcement or regulatory authorities where required by law.
5.5.3.4 Preservation and retention of relevant evidence for investigation, enforcement, or legal compliance purposes.
5.6 Copyright & DMCA Takedown
Dayo respects the intellectual property rights of others and expects users to do the same. 077. Limitation of Liability
To the maximum extent permitted by applicable law, Dayo, I.T Services. and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including loss of data, lost profits, or personal injury, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid to us in the twelve months preceding the claim, or (b) one hundred Philippine pesos (PHP 100).

7.1.1.5 That all matches, events, or interactions will be safe or free from risk.
7.1.1.6 That other users will behave appropriately, lawfully, or in accordance with expectations.
7.1.1.7 That the Service will always produce successful, suitable, or optimal matches between users.
7.1.2 User Acknowledgement of Risk
By using the Service, you acknowledge and agree that certain risks are inherent in online platforms and real-world interactions facilitated through the platform.
7.1.2.1 The Service may experience technical failures, crashes, or unexpected downtime.
7.1.2.2 Features or functionalities may be modified, suspended, or discontinued at any time.

7.2 Dayo Does NOT Referee Matches
Dayo operates solely as a digital platform that facilitates connections, coordination, and organization of sports-related activities. Dayo does not participate in, supervise, or officiate any physical or in-app matches or events.
7.2.1 Platform Limitations
Dayo does not assume responsibility for match outcomes or user interactions during events.
7.2.1.1 Dayo does not observe, monitor, or referee matches or games.
7.2.1.2 Dayo does not determine winners, scores, or outcomes of any match.
7.2.1.3 Dayo does not enforce sports rules or regulations between players.
7.2.1.4 Dayo does not resolve disputes related to gameplay or competition results.
7.2.1.5 Dayo does not investigate allegations of cheating, match-fixing, or unfair play.
7.2.1.6 Dayo does not mediate financial disputes between users.
7.2.1.7 Dayo does not act as an intermediary in disagreements between users.
7.2.2 User Responsibilities
Users are solely responsible for managing their participation in matches and resolving any issues that arise between participants.
7.2.2.1 Users are responsible for resolving disputes directly with other participants.
7.2.2.2 Users must ensure mutual agreement on rules, conditions, and expectations prior to participation.
7.2.2.3 Users are responsible for handling any payment, booking, or arrangement issues between themselves.
7.2.2.4 Users may contact appropriate authorities in cases involving fraud, illegal activity, or safety concerns.
7.2.3 Dispute Handling Guidance
In the event of a dispute between users, Dayo recommends the following escalation process:
7.2.3.1 Attempt to resolve the issue directly between the involved parties.
7.2.3.2 Contact the match organizer or event host, if applicable.
7.2.3.3 Pursue resolution through applicable legal channels such as small claims court if necessary.
7.2.3.4 Contact law enforcement authorities if the matter involves criminal activity.
Dayo’s role is limited to enforcing Community Guidelines and removing users who repeatedly violate platform rules. Dayo does not intervene in individual disputes between users beyond platform safety enforcement actions.
7.3 Limitation of Liability
To the maximum extent permitted under applicable law, Dayo, its affiliates, officers, employees, agents, and licensors shall not be liable for any damages arising out of or related to your use of or inability to use the Service.
7.3.1 Excluded Damages
Dayo shall not be responsible or liable for any of the following categories of loss or damage, whether direct, indirect, incidental, consequential, special, or punitive:
7.3.1.1 Any direct, indirect, incidental, special, or consequential damages arising from use of the Service.

7.3.2 Excluded Categories of Compensation
To the fullest extent permitted by law, Dayo shall not be liable for any of the following, even if such damages were foreseeable or could have been prevented.
7.3.2.1 Medical expenses, hospital bills, or injury-related costs arising from participation in matches or events.
7.3.2.2 Lost wages, income, or work opportunities resulting from injuries or incidents.
7.3.2.3 Damage to sports equipment or personal belongings.
7.3.2.4 Financial losses resulting from fraud or misconduct by other users.
7.3.2.5 Emotional distress, mental anguish, or non-economic damages.
7.3.2.6 Punitive, exemplary, or aggravated damages intended to punish conduct.
7.4 Cap on Damages
To the maximum extent permitted by applicable law, Dayo’s total aggregate liability for any claims arising out of or related to the Service shall be limited as set out below.

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your license to use the Service will immediately cease.
You may delete your account at any time through the app settings. Account deletion is subject to the data retention practices described in our Privacy Policy.

Dayo reserves the right to suspend, restrict, or permanently terminate your account at its sole discretion, with or without prior notice, where necessary to protect users, enforce these Terms, or comply with applicable law.

8.1.1.4 Exploitation of bugs, glitches, or security vulnerabilities within the Service.
8.1.1.5 Creation or use of multiple accounts to evade enforcement actions or bans.
8.1.1.6 Use of bots, automated scripts, scrapers, or unauthorized automation tools.
8.1.1.7 Misrepresentation of identity, impersonation, or fraudulent conduct.
8.1.1.8 Participation in match-fixing, cheating, or manipulation of outcomes.
8.1.1.8 Initiation of fraudulent chargebacks or payment disputes.
8.1.1.10 Any violation of child safety protections or related safeguarding rules.
8.1.1.11 Posting or distribution of illegal, highly harmful, or prohibited content.
8.1.2 Enforcement Outcomes
The severity of enforcement depends on the nature and frequency of
violations.
8.1.2.1 Serious violations may result in immediate and permanent termination without prior warning or opportunity to appeal.
8.1.2.2 Minor or first-time violations may result in escalating enforcement actions including warnings, temporary suspensions, and eventual permanent bans if behavior continues.
8.2 Levels of Enforcement
Dayo applies a graduated enforcement system designed to ensure fairness, proportionality, and consistency in addressing violations of these Terms.
8.2.1 Level 1: Warning
8.2.1.1 The violating content may be removed from the platform.
8.2.1.2 A formal warning notification is issued to the user.
8.2.1.3 The user may receive guidance or educational information regarding the violated policy.
8.2.2 Level 2: Temporary Suspension (24–48 Hours)
8.2.2.1 Account access is temporarily disabled for a period of twenty-four (24) to forty-eight (48) hours.
8.2.2.2 The user will be unable to log in or access platform features during this period.
8.2.2.3 A notice explaining the reason for suspension will be provided.
8.2.2.4 Access is automatically restored after the suspension period ends, provided no further violations occur.
8.2.3 Level 3: Extended Suspension (7–30 Days)
8.2.3.1 Account access is disabled for a period of seven (7) to thirty (30) days.
8.2.3.2 This level is typically applied for repeated or more serious violations.
8.2.3.3 A notification outlining the violation and suspension duration will be provided.
8.2.3.4 Access is automatically restored after the suspension period unless further enforcement actions are required.
8.2.4 Level 4: Permanent Ban

Certain severe violations may result in immediate account termination without prior warning due to the seriousness of the conduct involved.

When enforcement actions such as suspension are applied to your account, Dayo will provide notice and relevant information regarding the decision, subject to safety, legal, and operational limitations.

8.4.2.2 Dayo may uphold, modify, or reverse the original enforcement decision based on the findings of the review.
8.4.2.3 The outcome of the appeal will be communicated via email.
8.4.2.4 The decision issued after appeal review is considered final and may not be subject to further internal appeal, except where required by applicable law.
8.5 Account Deletion by You
Users may request deletion of their account at any time through the platform settings. Account deletion is processed in accordance with applicable data retention and legal requirements.

When an account is suspended or terminated, Dayo processes associated data in accordance with legal obligations, platform integrity requirements, and security policies.

8.6.1.1 User profiles may be hidden from public visibility within twenty-four (24) hours.
8.6.1.2 Private messages may be deleted or anonymized within twenty-four (24) hours.
8.6.1.3 User-generated content may be deleted or anonymized within forty-eight (48) hours, where applicable.
8.6.1.4 Content created by other users that is not owned by the terminated user may remain available.
8.6.1.5 Match history and related records may be retained for integrity, dispute prevention, or audit purposes.
8.6.1.6 Payment and transaction records may be retained for up to seven (7) years in compliance with legal and financial record-keeping requirements.
